61F out there this afternoon!
I flipped my kitchen card calendar to the Jack of Spades today, and since this is a leap year, it won't get flipped again until next Tuesday.
And that also means February will be giving way to March this week... on Friday.
My main goal for the week is to get the bills paid, and straighten out the BS with ComEd.
But I also want to start getting more sleep!
No more YouTube storyboard videos for a while.
It's been fun to make those, but they keep me up too late at night during the week... and they cost too much money.
And my ears are fried from the studio, so I'm taking a break from that too.
This also came in on Friday...
"Patrick,
We served the Plaintiff’s counsel today with Discovery Requests.
They have 28 days to respond. Once they respond we will be able to inquire about payment options available to you.
Attorney V____ will be in touch with you to go over Plaintiff’s responses and the next steps."
So I sent her a response telling her about the meetings in May of 2022 with Stephany, because there has to be records of it.
If they're doing discovery, maybe they can dig up an actual report by Stephany saying that she told Dad he'd have 10 years to pay off the loan.
Anyway... time to go to work.
A new four hour guy started today, by the name of Raf.
This is the fourth person for the 4-hour area (not counting myself) since I've been at Cloud.
But Raf is full time! He'll be doing our 4-hour area from 3PM to 7PM, and then four more hours at another nearby school.
And he lives close to both schools, and has a kid enrolled at Cloud.
All of this would seem to mean he'll stick around, but we'll see.
If so, it's good for me, because he's always gonna be there by 3:00 and gone by 7:00... unlike Rosa who kept showing up later and later, or Darnise, who never showed, or Lillian, who for some reason always stayed for five hours no matter what.
If Raf is reliable, and competent, it keeps Chantele away, and it also leaves me by myself after 7PM... both of which make it easier for me to smoke in my car without having to worry about getting caught.
No Prowly when I got home tonight, but the food I left out for him is all gone, so he's around.
As for Snoop... I dunno.
I'm sad, and I miss him, but... if he's happier with some other human, then I can't begrudge him that.
I googled a bit about Discovery Requests in foreclosure cases.
Apparently, they are very important for the defense, and can sometimes lead to a better outcome, or a case dismissal, if the plaintiff (BMO) isn't cooperating.
But it does mean that there is still a court case being prepared for. Discovery is only for court cases.
So when the paralegal says they'll be asking about my payment options... that would seem to be a way to settle out of court.
However, for the moment, there is still a potential court date on the horizon.
I still think the Stephany angle is something that would only help my defense, and it does seem like Discovery is the way to get the records of those meetings in 2022 with her, when Dad was still alive.
At the very least, such records would show that Dad & I went to them for help with the issue a year in advance, and they did not end up helping him in any way.
And if the records do show that Stephany advised him he'd have 10 years to pay off the loan, then it doesn't matter if she was mistaken, because she still prevented us from looking for other alternatives to deal with the balloon.
And these records are just the kind of thing that BMO would be unwilling to produce... because it makes them look bad.
And if they did refuse to produce them, they could be compelled... and that'd hurt their case.
I'd like... to whatever extent I can manage it, to show that BMO has been acting in bad faith thorugh this whole process.
It started with Stephany lying to Dad, which set him up to be blindsided by the balloon.
They also stonewalled my first lawyer, and kept the status of the balloon as delinquent, so as to make it appear to underwriters that it was my debt, and prevent me from paying it back.
They filed the suit against me, instead of the estate, in an attempt to make this my debt, either by scaring me into assuming it... or getting a judgement against me, if I didn't answer the summons.
Meanwhile, all my receipts show a man acting in good faith, starting a year before the loan hit maturity.
And as for squatter's rights, the two things you need to have that, besides just living somewhere, is to pay the taxes, and maintain the property.
And I have ample video evidence that I've been maintaining this property with my own money, and handiwork since 2019.
And all of this together, I would think... might lead a judge to tell BMO, no, you have to give this guy 10 years to pay that down, like he was told.
Because I didn't sign the loan papers with the balloon clause in them... I have squatter's rights... and I've been acting in good faith.
The trouble is, the longer this takes, the lower my credit score goes, and the more credit cards I max out... which means at some point I'm just out of money... to live on... to defend myself... or do anything.
And if BMO just times me out... I'll be forced to sell, because it'll be my only way out of this mess.
